AGREEMENT FOR THE LETTING OF FURNISHED PREMISES (NARROWBOAT HARMONIA)

Tenant:

Premises: Narrowboat Harmonia (formerly Moshulu), Boaters Box, Oxford Canal Towpath (St. Ed’s), Woodstock Road, Oxford OX2 7AH

Rent: 500 pounds sterling for ten calendar month, payable in advance by direct debit to J Franklin, Lloyd’s TSB Summertown Branch, Acct. No. 00367027. Sort Code 30 9404.

Term: From September 9 2004 to June 9 2005, and thereafter from month to month.

Deposit: One thousand pounds sterling (£1000), to be returned subject to Clause 4 below.

The Letting Clauses

1. The boat is let as a houseboat, not as a cruising vessel. The tenant may only cruise with permission of the owner, and then takes all liability for any damage incurred while cruising. The only exception will be trips relating to repair work, authorized beforehand by the landlords; in this case, the boat will be moved by the proxy landlord, Mr Benjamin Ming of Narrowboat Avalon, St. Ed’s.
2. Long term mooring only to be done in the St Edwards to Upper Wolvercote stretch.
3. There is to be no sub-letting. Two month’s notice will be given by landlord, one month by tenant.
4. Any damage above the normal wear and tear shall be deducted from the security deposit. This includes any damage not convered by insurance or insurance excess, which currently stands at £500.
5. The generator and solar panels are not to be lent. Both must be kept locked at all times.
6. The generator is not inclusive of the deposit and any loss or damage not reclaimable through insurance shall be the tenant’s responsibility.
7. All furniture and fittings on Harmonia are to remain there and not to be lent or given without prior consent of the Landlord.
8. Reasonable care shall be taken to ensure the wellbeing of the boat (leaks and minor repairs reported and addressed), and to pump/bail the bilges when needed.
9. The Landlord remains responsible for license, insurance and mooring fees. The tenant must negotiate his own contents insurance. The tenant’s contents are not covered by the landlord’s policy.
10. The Tenant, paying the rent and performing other obligations detailed, shall be allowed quiet possession and enjoyment of the narrowboat without any interruption by the Landlord.

Responsibility for the Narrowboat Moshulu/Harmonia includes guardianship of the following items:

For full reimbursement of the security deposit you must leave me the boat as I left it for you:
Full tank of diesel
Full tank of calor gas
Walls, cooker and cupboards washed
Coal stove and storage bucket emptied
Rubbish removed
Toilet emptied
Shower and sink cleaned
Curtains and deck chair fabrics in a clean, dust-free condition
All contents (see above) accounted for – and keys
Top of boat and decks cleared of all rubbish/detritus
If the tenant fails to fulfill any of the foregoing, the amount shall be deducted form the security deposit. Cleaning etc. will be charged at the rate of 10 pounds sterlin/hour.

Minor repairs will be reimbursed by cheque, provided that both repair and estimated cost have been approved first. Major repairs will be billed directly to the landlord’s credit card, though the tenant remains responsible for arrangements.
